John Bekavac v. Local 856 [2009] Case No. 50/09/LRA (Manitoba Labour Relations Board)

The member (Bekavac) made an application to compel financial disclosure.  While the local had provided the member with its audited financial statements, the member sought further particulars regarding wages paid to individual employees and the basis for their salaries and other total remuneration.  In its reply, the local asserted that it had complied with the requirements of the Labour Relations Act and that the member’s application should be dismissed without a hearing on the basis that the member had failed to establish a prima facie case.  The Board dismissed the member’s application.  The audited financial statements provided by the local met the requirements of the Labour Relations Act.
