IATSE Local 262 v. AMC Entertainment International Inc. – AMC Forum 22 Inc. [2009] (Arbitral Decision)

French language arbitral decision determining first contract monetary issues by way of “last best offer” method.  The arbitrator selected the employer’s “last best offer”.  With respect to ushers, the decision provides for a wage scale ranging from $9.15 (15 cents above minimum wage) to $10.95 for employees with 10 years experience in the final year of the contract.  Due to the incentive placed on both parties to submit a reasonable offer, this range is almost identical to what the local had proposed in its last best offer.  With respect to projectionists, the decision provides for a range of $12, $13 and $14 in the first, second and third years of the contract, respectively.  While this range is somewhat lower than what the local had proposed, it is worth noting that these amounts represent increases of 33% in the first year, 8.3% in the second year and 7.7% in the third year of the contract.  With respect to retroactivity, the arbitrator’s decision provides for 6 months for both ushers and projectionists (whereas the local’s offer had provided for twelve months for ushers and six months for projectionists).
