Local 471 v. City of Ottawa [2010] (Arbitrator William Kaplan; Interest Arbitration)

An interest arbitration board was consensually constituted and a hearing was held in Ottawa on November 16, 2009.  Based on normative criteria, especially replication of conditions either agreed to by the employer with its other unions or awarded at arbitration, the Arbitrator determined the key outstanding issues as follows:

• • Use of Volunteers: Volunteers may only be used at the Centrepointe Theatre in amateur, charitable, community and or educational events – and not for commercial for profit events;
  • Overtime: All work performed on Sunday hall be paid at double time;
  • Vacations: Increased to provide for 6% upon hire and 8% after five years;
  • Wages (including retro): January 2005: 3%; January 2006: 3%; January 2007: 3%; January 2008: 3.25%; January 2009: 2.5%; January 2010: 2.5%; January 2011: 2.75%.
