ACFC West Local 2020 v. Local 891 [2004] B.C.L.R.B.D. No. 344 (BC Labour Relations Board)

First of two decisions.  ACFC applied for a cease and desist order against the IATSE local, asserting that the IATSE local’s policy of expelling its members who maintain dual membership is intimidation and coercion and contrary to the Labour Code.  The Board found that the IATSE locals actions could not be considered an objective or reasonable defensive action and ordered that it cease and desist from requiring its members to choose between ACFC and itself by threat of expulsion from the IATSE, and to cease and desist from laying and prosecuting charges against ACFC members by reason of their membership in ACFC.
