Carpenters local 1386 applied to certify all employees of the production engaged in carpentry work in the province of New Brunswick. Both Star Hunter Production and local 849 disputed the application. The Board found that the appropriate bargaining unit was “all employees of Star Hunter Productions…engaged as film technicians ‘below the line and behind the camera…” Accordingly, it denied the Carpenters’ local’s application on the basis that it did not have 40% of the employees in this bargaining unit. In arriving at this decision, the Board found that the carpentry work performed on film sets was not construction industry work within the meaning of the legislation and also considered the nature and history of the film industry across North America as support for its finding that a bargaining unit composed of “all employees…engaged as film technicians” was more preferable to allowing for craft-based bargaining units.
