IATSE Local 210 applied to be certified for a unit of stage and production employees. The Board allowed the application and ordered a representation vote. The Board found that, contrary to the Employer’s argument, a bargaining unit of “stage and production” employees does not include musicians, and therefore the Union had more than 40% support of the bargaining unit it had applied for. The Board concluded that a bargaining unit that excludes musicians was appropriate because there is a natural division between the interests of stage and production employees as compared to those of musicians and front house staff. The Board denied the Symphony Society’s argument that either the Concert Hall or the Union was the employer. The Board concluded that the Symphony Society was the employer of stage and production employees for the following reasons: the employees were requisitioned through the Union by the Concert Hall acting on the Symphony’s behalf; the employees worked in a composite crew with Concert Hall employees; the employees were under direction and control of, and paid by, the Symphony Society.
