The Union grieved the Employer’s failure to pay stage hands the minimum four hour pay guarantee for a Take Out Call that followed a Performance Call. Arbitrator MacDowell accepted the Union’s position that the Performance Call constituted a work period that was distinct and separate from the Take Out Call that followed it. Accordingly, Arbitrator MacDowell concluded that the Take Out Call was a separate bundle of work covered by the “catch-all” clause found in Article 5.8 of the Collective Agreement – “four hours shall constitute the minimum call for all work other than that referred to in this Article Five”. In doing so, Arbitrator MacDowell ordered the Employer to pay each Union member that worked the Take Out Call following the Performance Call the minimum four hour pay guarantee for the Take Out Call notwithstanding the fact that the Take Out work was completed in two hours.
