Jarrett v. Local 873 [1999] O.L.R.D. NO. 4090 (Ontario Labour Relations Board)

Second of two decisions.  Duty of fair representation complaint by member (Jarrett) who had his classification seniority reduced as per the local’s Constitution after failing to pay dues and being suspended twice in 5 years.  The Board held that the local had acted in an arbitrary manner and had therefore breached its duty of fair representation and as a remedy directed the local to reinstate the member’s classification seniority.
