Local 212 v. Theatre Junction Society [2007] A.L.R.B.D. No. 33 (Alberta Labour Relations Board)

Application for certification.  The local sought to be certified for “all employees [of the theatre] except office, clerical, performers, designers and front of house personnel”.  A vote was held and the ballot box was sealed after both parties raised objections regarding which employees should be included in the bargaining unit.  The Board held that the technical director should be excluded because he performed managerial functions, that the production manager should be excluded on the basis of the “office” exclusion and amended the bargaining unit description to exclude another employee on the basis that he did not perform technical duties as “facility operations manager”.
