Local 357 v. Stratford Shakespearean Festival of Canada [2004] O.L.R.D. No. 3623 (Ontario Labour Relations Board)

Application for certification (first of three decisions).  The local had previously been found to be a trade union within the meaning of the Act.  Not less than forty percent of the individuals in the proposed bargaining unit were members of the local at the time the application was made.  There was a dispute between the parties as to whether the positions of Head of Wigs and Make-up should be included in the bargaining unit.  The Board directed that a representation vote be taken of “all wig hair and make-up employees of The Stratford Shakespearean Festival of Canada in the City of Stratford, save and except Assistant Director of Production and persons above that rank.” and further that any disputed ballots be segregated and not counted until the Board so ordered or the parties agreed.
