Local 357 v. Stratford Shakespearean Festival of Canada [2004] O.L.R.D. No. 875 (Ontario Labour Relations Board)

Application for certification (second of three decisions).  No representations were filed with the Board.  The Theatre argued for the exclusion of “Head of Wigs and Make-Up Avon and Tom Patterson, and Head of Wigs and Make-Up and persons above that rank” from the bargaining unit description.  The Board found that not less than fifty percent of the ballots were cast in favour of the local, regardless of the outcome of the dispute over the bargaining unit.  Accordingly, it issued an interim certificate and appointed a Labour Relations Officer to inquire into and report on whether the parties had resolved the bargaining unit description dispute in the course of collective bargaining.
