Local 461 v. Shaw Festival Theatre Foundation [2008] 1270-08-R (Ontario Labour Relations Board)

Application for certification.  Following a representation vote, there remained a dispute three issues: a dispute with respect to the status of two employees; the bargaining unit description; and the applicant’s status as a trade union.  The Board held that the local was a trade union within the meaning of the Act, left the other two issues for bargaining as per an agreement between the parties, and issued an interim certificate.
