Local 58 v. GBSP Centre Corp. (Soulpepper) OLRB No. 0653-09 (Ontario Labour Relations Board)

Application for certification.  Local 58 was certified for “all stage employees employed by GBSP Centre Corp. o/a Young Centre for the Performing Arts in the City of Toronto, save and except Assistant Technical Director and persons above that rank.”  In granting the certification, the Board rejected the Theatre’s position that the Board should decline to apply the bright line test/day of application rule, which was established in TheatreCorp and followed in subsequent cases such as Crocodile Services, in favour of the blended test that the Board adopts in respect of industrial applications—that is the connection between the worker and the employer and reasonable prospects of return to work.
