Local 822 v. Canadian Opera Co. [2004] O.L.R.D. No. 3169 (Ontario Labour Relations Board)

Application for certification (First of two decisions).  The local had previously been found to be a trade union within the meaning of the Act.  Not less than forty percent of the individuals in the proposed bargaining unit were members of the local at the time of the application.  There was a dispute regarding the bargaining unit description.  The Board directed the taking of a representation vote of “all wardrobe employees of the Canadian Opera Company in the City of Toronto, save and except Wardrobe Department Head and persons above that rank.”
