Local 856 v. Teamsters Canada ID#165/2000 (Umpire: Wilfred List)

Local 856 alleged that Teamsters Canada had violated the Constitution of the Canadian Labour Congress in raiding local 856 in Winnipeg by recruiting its members employed by VZS, Winnipeg Pictures Inc. in the movie company’s transportation department.   The Umpire accepted that the Teamsters may have violated the spirit of the CLC Constitution but found that on a literal interpretation they had committed no violation.  In particular, he found that the Teamsters had not violated the CLC Constitution because while an IA collective agreement was in place such agreement had not been in place for a period of one year or more as required by the CLC Constitution.
