Local B-173 v. Corporation of Massey Hall and Roy Thompson Hall [2004] O.L.R.D. No. 883 (Ontario Labour Relations Board)

Application for certification and unfair labour practice complaint (Second of four decisions).  A representation vote was held and a significant majority of employees voted against the local.  The local alleged that the employer had breached the Act in the way it had campaigned against the local.  The employer contended that the local’s complaint should be dismissed as failing to disclose a prima facie case.  The Board examined the jurisprudence and declined to dismiss the local’s complaint as failing to disclose a prima facie case.
