Mysts Productions v. ACFC and Local 891 and Teamsters Local 155 and CEP [2007] B.C.L.R.B.D. No. 229 (BC Labour Relations Board)

The CEP sought standing to speak to the issue of whether ACFC membership cards established “membership in good standing” for the purposes of ACFC’s application for certification.  The Board denied CEP’s application for standing.  First, it found that CEP did not have status as an interested party because it was not a trade union under the Code and its interests would only be incidentally affected by Board’s decision.  Second, the Board refused to exercise its discretion to grant CEP intervenor status because it was not persuaded that CEP’s involvement would provide a different perspective that would significantly assist the Board’s determination.
