First of three decisions. Application by the employer to vary to local’s certification by deleting administrative personnel and creating a separate certification and a separate bargaining unit for such employees. The employer argued that there had been a change in circumstances insofar as the bargaining unit had become dysfunctional and was therefore no longer appropriate. The administrative employees also applied to revoke their bargaining rights. The Board reviewed the jurisprudence and found that the employer would have to demonstrate a change in circumstances before it would consider the wishes of the employees. On this basis, the Board denied the employer’s application having found that there were no changed circumstances and the application was based on employee wishes alone. The administrative employees’ application to revoke their bargaining rights was also denied on the basis that they did not have the requisite support of the entire bargaining unit.
