Rena Islic and Wenona Horton v. The International Alliance of the Theatrical Stage Employees, Moving Picture Technicians, Artists and Allied Crafts of the United States, its Territories and Canada, Local B-173 v. Compass Group Canada (OLRB – January 2, 2015)

This is an Application for Termination of Bargaining Rights in which the Applicants allege that the Union no longer represents the employees in the bargaining unit.

The Board found that the evidence of employee wishes submitted with the application is deficient as the Applicant submitted the Board’s Form Declaration Verifying Evidence of employee wishes signed by a number of employees.  This form does not include a statement to the effect that the employee does not wish to be represented by the Union.  As a result, the Board found that none of the employees and the bargaining unit expressed a wish not to be represented by the trade union and dismissed the Application.

Having dismissed the Application, the Board commented that the applicants are free to collect statements from employees that express “I no longer whish to be represented by IATSE, Local B-173 in my employment with Compass Group Canada at Hamilton Place” and to “file another application seeking to terminate the Union’s bargaining rights”.
