Taylor v. Local 891 [1999] B.C.L.R.B.D. No. 139 (BC Labour Relations Board)

Duty of fair representation complaint.  Member (Taylor) alleged that the local had withheld membership from him in a discriminatory manner and failed to dispatch him on two occasions.  As remedies, he sought a seniority adjustment, damages and legal costs. The Board dismissed the member’s complaints on the basis of timeliness; i.e. they were filed well after the statutory time limits for such complaints.
