The UBCP applied for a declaration that a term of an agreement it had negotiated with the UCBU and the PSAC which established the eligibility of “Background Extra Members” to participate in strike and ratification votes, was consistent with the Labour Code. Local 891 opposed the application on the basis that the term was inconsistent with industry practice. The Board declined to grant the declaration on the basis that there would be no labour relations purpose to granting the application since the UBCP did not yet represent the background extras in any collective bargaining relationship.
