Walker v. Local 891 and Stargate SG-1 [2005] B.C.L.R.B.D. No. 99 (BC Labour Relations Board)

Duty of fair representation complaint wherein the member (Walker) alleged that the local had failed to represent him when he lost his job.  In particular, he alleged that the local had failed to question the employer regarding a discrepancy between the verbal reasons given for his discharge (replacement) and the written reasons given (layoff).  The Board found that the local had made a mistake in failing to question the employer regarding the discrepancy between the oral and written reasons for the discharge; however, unions are entitled to make mistakes and this mistake was not sufficient to constitute arbitrary conduct within the meaning of the duty of fair representation.
