Local 295 v. Saskatchewan Centre of the Arts [2008] SKCA 136 (Saskatchewan Court of Appeal)

Second of two decisions.  The local appealed the judicial review decision of the Saskatchewan Court of Queen’s Bench in Saskatchewan Centre of the Arts v. Local 295 [2007] S.J. No. 650.  The appeal was allowed in part.  The part of the judgment directing the Board to reconsider damages taking into account the grievor’s earnings after dismissal was affirmed, while the part of the judgment directoring the Board to reconsider damages on the basis of the workplace not being unionized for the whole period of the grievor’s employment was set aside.
