Grabowski v. Local 210 [2003] Alta. L.R.B.R. LD-020 (Alberta Labour Relations Board)

Duty of fair representation complaint by the member (Grabowsk) alleging that the local had imposed discipline in a discriminatory manner.  The local raised two preliminary objections; first, that the Board had no jurisdiction because the member had failed to take advantage of the Union’s internal appeal processes before filing a complaint; and second that complaint should be dismissed as untimely.  The Board dismissed the complaint as untimely.  There was a lengthy period of delay which would prejudice the local and for which the member had no reasonable excuse.
