Langston v. Teamsters local 155, the BC Council of Film Unions and Dungeon Siege Productions Inc. [2008] B.C.L.R.B.D. No. 52 (British Columbia Labour Relations Board)

Duty of fair representation complaint by member (Langston) where the Teamsters local 155 and the BC Council had refused to file a grievance challenging the termination of the member’s employment.  The Board held that the Council did not breach its duty by delegating responsibility for the investigation of the member’s grievance to the Teamsters local.  The Board also refused the member’s complaint on the basis of res judicata; i.e. he had already had similar complaints refused by the Board in earlier proceedings.
