Windsor, [2008] BCLRB No. 119 (BC Labour Relations Board)

The British Columbia Labour Relations Board dismissed a complaint of unfair representation against Local 891 when it refused to proceed to arbitration and settled a grievance contrary to the wishes of a member.  The member’s failure to provide the Union (or the employer) with a timely explanation of his conduct effectively precluded the Union from investigating the grievance in a more meaningful way or from characterizing the Union’s conduct as arbitrary.  Scepticism about the member’s case did not constitute either fear of the employer or bad faith on the part of the Union.
