Nantel v. Local 348 [2003] B.C.L.R.B.D. No. 97 (BC Labour Relations Board)

First of two decisions.  Duty of fair representation complaint by the member (Nantel) alleging that the local had failed to pursue a grievance over Famous Players’ refusal to accept him for employment.  The Board dismissed the duty of fair representation complaint on the basis that the duty did not apply to Nantel since he was not an employee but rather a person awaiting dispatch under a union hiring hall.  Nor was there any basis for the duty of fair referral complaint since there was no indication that the local refused at any time to refer Nantel to Famous Players.
