Steve Mahun v. Local 873 [1998] O.L.R.D. No. 1849 (Ontario Labour Relations Board)

Duty of fair representation and fair referral complain by the member (Mahun) who had been refused membership by the local.  The Board found that the member’s complaint lacked a factual basis and had been filed in ignorance of the local’s membership-granting procedures.  Nonetheless, the Board decided remain seized of the matter and gave the member a fresh opportunity to file new submissions.
