The Employer applied to the BC Labour Relations Board for review of the award of Arbitrator Ready regarding the termination grievance of Amanda Bronswyk. The Employer challenged the Arbitrator’s findings that the Grievor had standing to grieve her termination that was imposed after the project had ended. It also challenged the Arbitrator’s award of damages for loss of opportunity and mental distress. The Board dismissed the Employer’s application. It found that Arbitrator Ready correctly concluded that the Grievor had standing to bring the grievance, and that it should not interfere with the Arbitrator’s decisions to award damages for loss of opportunity and mental distress because the Arbitrator’s decision was the product of an adequately reasoned analysis that was consistent with the principles of the Labour Relations Code.
