- Duty of Fair Representation
A French language decision. The Quebec Board rejected a duty of fair representation complaint. In particular, the Board found that disciplinary action imposed by the local (placing the member at the bottom of the local’s seniority list and imposing a fine) was a matter of the union’s internal affairs rather than one pertaining to the collective agreement. Since the matter did not relate to the collective agreement, the Quebec Code’s provisions relating to the duty of fair representation did not apply and the member’s recourse would be with the courts.
