Sony v. Local 348 and the BC Federation of Labour [1999] B.C.L.R.B.D. No. 519

During a lockout of local 348 members by Cineplex Odeon, the local and BC Federation of Labour engaged in the leafleting of a Sony store (Sony owned a significant share of Cineplex’s parent company).  Sony applied to restrain leafleting at the Sony store and prohibit future anticipated leafleting at other Sony stores throughout the province.  The Board applied the Supreme Court’s decision Kmart to reject Sony’s application on the basis that the leafleting constituted a legitimate form of freedom of expression protected by Section 2(b) of the Charter of Rights and Freedoms.
