Wright v. Local 873 [2008] OLRB No. 3861 (Ontario Labour Relations Board)

The Ontario Labour Relations Board dismissed both an unfair representation and an unfair referral complaint by a member who had been suspended for inappropriate conduct and whose suspension was then unilaterally lifted by Local 873.  The Union had afforded the member an opportunity to make representations to the Executive Board before his suspension and the OLRB’s jurisdiction did not extend to evaluating the correctness of the Union’s decision that the member’s conduct was detrimental to the advancement of the purposes of the Union provided it was not made in bad faith or arbitrarily (of which there was no evidence).
